Terms and Conditions of Use

Welcome to the official central public procurement platform (the "Platform"). By accessing, browsing, or using this Platform—including viewing published tenders, downloading bidding documents, or registering as a supplier—you agree to comply with and be bound by these Terms and Conditions (the "Terms"). If you do not agree to these Terms, you must immediately cease using this Platform.
1. Regulatory Framework & Authority
This Platform is established and operated pursuant to [Insert Relevant Act/Law, e.g., The Public Procurement Act of 2024]. The Authority is legally mandated to regulate public procurement, set standards for fairness and transparency, and host the central repository for all government procurement activities. All procurement processes conducted via this Platform are subject to the governing laws of [Country/Jurisdiction]. In the event of any conflict between these Terms and the governing procurement legislation, the legislation shall prevail.
2. Platform Purpose & Scope
This Platform serves as the mandatory central gateway for public procurement. It facilitates procurement activities for:
* Government Ministries
* State Agencies and Departments
* Local Authorities and Municipalities The Platform is designed to ensure that the public bidding process remains free from undue influence, competitive, and accessible to all qualified suppliers.
3. Supplier Eligibility
To participate in bidding processes, suppliers must complete the registration process. You are entirely responsible for maintaining the confidentiality of your account credentials (username and password). Any activity, bid submission, or communication originating from your registered account will be legally deemed as an authorized action by your organization. You must immediately notify the Authority of any unauthorized account use.
4. Rules of Engagement & User Conduct
Users of the Platform (including procuring entities and suppliers) strictly agree NOT to:
* Submit fraudulent, collusive, or intentionally misleading bids or documentation.
* Attempt to bypass, manipulate, or compromise the electronic tendering security systems.
* Engage in anti-competitive behavior, bid-rigging, or any form of corrupt practice to influence procurement outcomes.
* Introduce malware, viruses, or malicious code designed to disrupt Platform operations.
⚠️ Enforcement Notice: Any suspected fraudulent, corrupt, or collusive behavior will result in immediate account suspension, disqualification from active tenders, and referral to law enforcement and anti-corruption authorities.
5. Tender Submissions & Electronic Bidding
The Platform operates on an automated server time-lock system. Bids submitted even one second after the published closing time will be automatically rejected by the system. The Authority bears no responsibility for network latency, slow internet connections, or local technical failures experienced by the user during submission.
Uploaded bid documents must strictly adhere to specified formats (e.g., PDF, Excel) and size limits. Corrupted files or files that cannot be opened during the official bid opening phase will be disqualified.
6. Intellectual Property & Data Usage
In alignment with our mandate for transparency, certain procurement data—including tender notices, award announcements, contract values, and winning supplier names—is public information and will be published openly.
Proprietary technical designs, trade secrets, or financial breakdown models explicitly marked as *Confidential* by a bidder within their submission will be handled in accordance with freedom of information laws and intellectual property regulations.
7. Amendments to Terms
The Authority reserves the right to modify or replace these Terms at any time to reflect changing legal requirements or Platform upgrades. Continued use of the Platform after changes are posted constitutes implicit acceptance of the revised Terms.
8. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of The Republic of Ghana. Any legal disputes arising directly out of the use of this digital Platform that cannot be resolved through administrative procurement review boards shall be subject to the exclusive jurisdiction of the courts of The Republic of Ghana.

Presidential Public Procurement Authority operates under the (fictional, for demonstration purposes) Public Procurement Act 2024 and its accompanying Regulations, which give the authority power to issue binding procurement guidelines, investigate complaints, and suspend suppliers found to be in breach of the Code of Conduct.

Who runs Presidential Public Procurement Authority
Reporting lines
The Board of Directors is appointed for staggered three-year terms and includes representatives from the Ministry of Finance, the private sector and civil society, so that no single interest group controls oversight of the procurement system.

A code of conduct for everyone on the platform
Every procurement officer who publishes a notice through Presidential Public Procurement Authority, and every supplier who registers to bid, agrees to the same Code of Conduct. It prohibits gifts or favours linked to a live tender, requires disclosure of any personal or business relationship with a bidder, and obliges officers to record the reasons behind every evaluation decision.
Breaches are investigated by the Compliance & Standards division and can result in a supplier being suspended from bidding, or an agency's publishing rights being reviewed by the Board.
Built with the people who use it
Presidential Public Procurement Authority runs quarterly consultations with the Chamber of Commerce and SME associations to review how well the platform is serving smaller suppliers, and an annual Procurement Forum that brings agency officers and bidders into the same room for open Q&A. Feedback from both has directly shaped features such as the closing-soon alerts and the simplified supplier registration form.
